Attorneys for the state of Illinois filed a notice of appeal with the federal district court that found the state’s gun and magazine ban violates the U.S. Constitution. Illinois banned the sale and possession of more than 170 semi-automatic firearms and magazines over certain capacities in January 2023.

A downstate federal judge on Friday ruled that Illinois’ sweeping gun ban is unconstitutional and can no longer be enforced after 30 days. The ruling comes nearly two years after the ban on certain high-powered guns and high-capacity magazines was signed into law by Gov.

A federal judge has overturned Illinois’ ban on semiautomatic weapons, leaning on recent U.S. Supreme Court rulings that strictly interpret the Second Amendment right to keep and bear firearms.

Officials in the state have already filed an appeal after the Trump-appointed judge’s ruling, which cites recent Supreme Court decisions on the Second Amendment.

On Friday, a federal judge found that Illinois’ semi-automatic gun and magazine ban is unconstitutional. Judge Stephen Glynn issued a 30 day stay on the ruling, allowing for the state to appeal, according to The Center Square.

U.S. District Judge Stephen McGlynn says the law bans firearms covered by the Second Amendment and is not supported by historical precedent.
